1General Terms

Fuchs Travels LLC ("Fuchs Travels," "we," "our," or "us") operates a photography tour booking platform. Tours listed on our platform may be operated directly by Fuchs Travels, by partner tour operators, or by independent guides. The specific tour operator is identified on each tour listing page.

You must be at least 18 years of age to create an account, make a booking, or use our services. By using our platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

We reserve the right to cancel bookings, change assigned tour guides, and modify itineraries and/or schedules if necessary due to road conditions, severe weather, or other unforeseen circumstances. Prices for confirmed bookings are honored at the confirmed price; pricing for new or unconfirmed bookings may change without notice.

For tours operated by partner tour operators, the operator's own terms and conditions may also apply in addition to these terms. In the event of a conflict, these platform terms govern the booking process, while the operator's terms govern the tour experience itself.

2Payments Accepted

We accept payments through major credit and debit cards (Visa, MasterCard, American Express, Discover) processed securely via Stripe. Additional payment methods may be available depending on the tour operator.

A full payment or deposit is required to secure your booking. Full payment is due 90 days before multi-day workshops, unless specified otherwise. Payment plans may be available upon request.

3Booking Procedure

Booking requests are processed within 48-72 hours. Include preferred dates, tour guides, and tour or custom itinerary requests. Requests are processed in the order received.

Due to high demand, not all tour guides and options may be available on your preferred dates.

A surcharge may apply in peak season for incidental fees, special booking requests, and preferred tour guide options. If your preferred tour and services are unavailable, we will contact you with alternative options.

Tours are conducted by Fuchs Travels or by our vetted partner tour operators. The responsible operator is clearly identified on each tour listing. When booking a partner-operated tour, your contract for the tour experience is with the tour operator, and Fuchs Travels acts as the booking platform.

4Cancellation & Refund Policy – If You Need to Cancel

If you need to cancel, notify us as soon as possible in writing via email at admin@phototours.com. Your cancellation is confirmed upon receiving our email acknowledgment.

Our cancellation policy varies for tours and workshops. Refunds are processed using the original payment method.

Workshops

For cancellations filled by another participant, a full refund minus a $300 USD fee is provided. If the workshop does not fill, the following applies:

• •More than 90 days before the start: Full refund minus $300 USD fee.
• •Less than 90 days: No refund, but funds are credited for use towards our packages, tours, or workshops for up to 2 years.

Partner-Operated Tours

For tours operated by partner tour operators, the partner's cancellation and refund policy governs the tour fee. Fuchs Travels will process refunds on behalf of the operator in accordance with their policy, which is displayed on the tour listing page at the time of booking. Partner-operated tours may have non-refundable deposits.

5Cancellation & Refund Policy – If We Cancel or Reschedule

Fuchs Travels reserves the right to reschedule or cancel workshops/tours due to low participant numbers, Force Majeure, weather, or safety concerns.

In case of rescheduling within two years, you may:

• •Retain your spot on the new date;
• •Transfer to another date, if available;
• •Apply your funds as credit towards other services for up to 2 years; or
• •Request a full refund.

If we cancel a workshop/tour, you may:

• •Apply funds towards another service; or
• •Receive a full refund.

Partner-Operated Tours

If a partner tour operator cancels or reschedules a tour, refunds for the tour fee are subject to the partner's cancellation policy. Fuchs Travels will facilitate communication between you and the operator and process any applicable refunds. If you are dissatisfied with the resolution, please contact us at admin@phototours.com.

6Photography Workshop Changes

Fuchs Travels may alter advertised itineraries, schedules, prices, and guides without notice and without participant consultation, due to participant numbers, logistics, illness, emergencies, weather, or other circumstances.

7Accommodation Selection & Availability

Accommodations may include:

• •Double Occupancy (shared with a companion or another participant of the same gender)
• •Single Occupancy

Solo participants choosing Double Occupancy may be requested to pay for Single Occupancy if a roommate is unavailable.

Single Room Availability

Limited on some workshops, assigned on a first-booked basis. If unavailable, you'll be notified and refunded the difference.

8Pricing Policy & Taxes

Pricing Policy

Prices are subject to change without notice. Peak season may incur surcharges and additional fees. All additional fees will be communicated prior to booking confirmation.

Taxes and Fees

Applicable sales tax will be added where required by law. A processing fee may apply for online payments and is displayed at checkout prior to confirmation.

9Liability Waiver & Insurance

Liability Waiver

Participants must complete a liability waiver before tours begin.

Insurance

Comprehensive travel insurance is advised for all clients. Insurance is mandatory for workshop participation.

Assumption of Risk

Photography tours involve outdoor activities that may take place in remote, rugged, or challenging environments. By participating, you acknowledge and accept the inherent risks associated with outdoor photography expeditions, including but not limited to uneven terrain, wildlife encounters, weather exposure, and altitude.

Platform Liability

For tours operated by partner tour operators, Fuchs Travels acts as a booking platform and is not the tour operator. The tour operator is solely responsible for the delivery, safety, and quality of the tour experience. Fuchs Travels' liability is limited to the booking and payment processing services we provide.

Limitation of Liability

To the maximum extent permitted by applicable law, Fuchs Travels' total liability to you for any claims arising out of or relating to these terms or your use of our services shall not exceed the total amounts you have paid to Fuchs Travels in the twelve (12) months preceding the event giving rise to the claim.

10Governing Law & Dispute Resolution

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.

Dispute Resolution

In the event of any dispute arising out of or relating to this Agreement, the parties agree to first attempt resolution through good-faith negotiation for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in the State of New York, conducted under the rules of the American Arbitration Association. Fuchs Travels will bear the arbitration filing fees for consumer claims. Claims within the jurisdiction of small claims court may be brought in small claims court in the State of New York instead of arbitration.

Jurisdiction

For matters not subject to arbitration — including enforcement of arbitration awards, preliminary injunctive relief, and small claims — any legal action shall be brought exclusively in a court of competent jurisdiction located in the State of New York. In the event of any dispute, the prevailing party shall be entitled to recover all reasonable attorney's fees, court costs, and related expenses.

Force Majeure

"Force Majeure" means events beyond reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions or travel advisories, severe weather, volcanic activity, wildfires, infrastructure failures, airline cancellations, and civil unrest.

11Photography & Intellectual Property

Your Photos

You retain full ownership and all intellectual property rights to photographs and media you create during tours. Fuchs Travels and tour operators make no claim to your work.

Photos of You

Tour guides and staff may photograph or film the tour experience, including participants. These images may be used by Fuchs Travels or the tour operator for marketing and promotional purposes only with your prior written consent. You may be asked to sign a separate photo consent or model release form before or during the tour.

User-Generated Content

If you upload photos, reviews, or other content to the Fuchs Travels platform (including galleries, contests, or reviews), you retain ownership of your content. By uploading, you grant Fuchs Travels a non-exclusive, royalty-free license to display, promote, and share that content on our platform and marketing channels, with attribution to you.

Platform Content

All content on the Fuchs Travels website — including text, design, logos, and graphics — is the property of Fuchs Travels LLC and may not be reproduced without written permission.
